Dam Special Fund Lawsuit: The Documents

In this case, the Foundation challenges the constitutionality of the Dam and Appurtenance Improvement or Removal Grant Program Special Fund, established by Act 232, Session Laws of Hawaii 2024.  The fund holds only legislatively appropriated monies and was formed for the express purpose of avoiding the requirement in the Hawaii Constitution that appropriated funds lapse after three years and are returned to the general fund.  The Foundation also contended that the Dam Special Fund fails to meet the standards for a grant of public money to a special fund.
